Home studio had advertised in our colony in june 011, for complete solution of home improvement, customized furniture and interior work and proposed a clear step by step method for the execution of the work undertaken by them. Based on that advertisement, what we perceived to be a very professionally run organization, and we met the concerned person and gave a complete checklist of requirements and paid an advance of 50000/-(Sep 011) and promised completion in 3 months time. Initially the architect shared a few designs and quotations for the CIVIL work, but to our dismay, sent an email after a month (19th oct 011) of receiving the advance that he cannot undertake the work and offering a refund to the advance that had been given to him. The refund amount given through the check was dishonored and after repeated reminders, it was credited back more than 30 days after the date mentioned on the check. This put us under a lot of inconvenience coasted us much more than our initial budget of 7 lakhs for which home studio had given us the quote. We completed to renovation in march 012. We again went back to home studio (7th april and 15th april 012) to order some furniture. The items included in the list were as under: 1. Customized L shaped sofa with laptop ledge of specified colour. The sample was to be taken from the site 2. Customized sofa cum bed 3. Customized center table with glass top this was very happily taken by the floor team along with an advance of 00/- (Checks dated 16th april 2012 and 1sy may 2012 of 00/- Each) and was promised the delivery in 45 days. We met the architect again and he assured us that the product will be delivered on time although we wanted it in 30 days instead of the standard 45 days. The address for the samples / Measurements to be taken and the product to be delivered was given. The balance of 00/- Was agreed to be paid at the time of delivery at the site. The team visited our house to take the samples of colour and the measurements for the furniture so that it can be customized to the requirements. The measurement was taken on a piece of paper and the colour sample was taken in a picture in a mobile camera. This was done on the weekend of 21st and 22nd april 012. After more than 50 days (around a week later than promised), we reminded them of that neither had anybody contacted us on the status of the furniture nor had any sample for the colour shown to us for the ensuring that the sample taken thru a mobile phone picture actually is the same that will be delivered. In a complete turnaround form what was promised, the shop responded that the product may be delayed by a few days and wanted the final payment to be cleared before we could inspect the furniture. They also insisted that the furniture has to be visually inspected and accepted in their showroom before it should be dispatched to the house for delivery. This was challenged by us saying that the colour and the fitment cannot be verified without the product being placed in the actual site. However, to verify the intent of the shop, we requested for the colour sample of the furniture to be got to the house along with the measurements of the furniture. This after great reluctance and hesitation, the team came over on 16th june 012. To our shock, the sample colour of the furniture was no-where near the one which had been requested. The actual measurements of the ready product also DID not match with the site measurements that were originally taken. The shop then requested for additional time to redo the furniture. The shop and the management since then have been delaying the delivery of the product even after repeated reminders and conversations with numerous employees of the shop. As of now it is more than 70 days with the management of the shop refusing to deliver the product and insisting that the inspection of the custom made product be done at their workshop before it is delivered. With the previous experience of mismatched colour, different size on paper as against the actual room measurements, it has been repeatedly conveyed to them that the acceptance cannot be signed off without the product being delivered and fitted at to the site. However no measure has been taken by the management to provide a satisfactory answer to our queries. When told that they are setting an example which will only "loose customers" and requesting senior managements intervention to solve the case, a person named anita (later claimed to be a senior management member),not only refuse to call us to speak but chose to send only insulting sms texts. I quote "u guys are so suspicious why do u step out to make a purchase" "type of client we should avoid" the only reason that the anita could give us after nearly 70 days for not delivering the product to us was that they have a policy that without the payment the product can’t be loaded on the trucks to be delivered. It was pointed out to her that this policy was never mentioned in the initial conversation with the sales staff and what balance of payment was agreed to taken at delivery of the furniture at our doorstep. Summary of the harassment the shop has made us undergo is as under 1. Unfair trade practice amounting to fraud and cheating the gullible customers into a sale by giving false hopes. 2. Failure to provide the service after taking advance 3. Failure to return the advance amount. Check had bounced due to insufficient funds. 4. Failure to deliver the product on the promised date. 5. Complete disregard to the customer and not taking correct steps to ensure correct delivery of the product. 6. Insulting the customers thru text messaging. 7. Showing discrimination towards customers. It feels that we have parted ways with our hard earned money to get only dissatisfaction, insult and harassment from the shopkeepers. The shop owners should be made liable for their mismanagement and suitably compensate us for the agaony caused.
